Terms & Conditions

1. Scope

These Terms & Conditions (“Terms”) govern access to and use of Zanware Marine (the “Service”).

By creating an account or using the Service, you agree to be bound by these Terms.

2. Description of the Service

Zanware Marine is a digital platform designed to support vessel management, crew coordination, and related operational activities.

The Service includes, but is not limited to:

  • Vessel management
  • Crew and guest management
  • Maintenance tracking
  • Budget and expense management
  • Documentation handling
  • Operational planning tools

3. User Accounts

To use the Service, users must:

  • Provide accurate and complete information
  • Maintain the confidentiality of their credentials
  • Be responsible for all activity under their account

The Service may assign roles (e.g., owner, captain, crew) with different access levels.

4. Acceptable Use

Users agree not to:

  • Use the Service for unlawful purposes
  • Upload or store illegal or unauthorized content
  • Infringe the rights of third parties
  • Attempt to disrupt, overload, or compromise the Service

5. User Content & Responsibility

Users are responsible for all data they input or manage within the Service, including:

  • Crew and guest data
  • Personal identification data
  • Operational records
  • Documents and files

Users must ensure they have the legal right to process and store such data.

6. Payments & Subscriptions

Where applicable:

  • Subscriptions are billed via:
    • Apple App Store
    • Google Play
    • RevenueCat
    • Stripe (web only)
  • Pricing, billing cycles, and plans may change over time
  • Payments are handled by third-party providers

The Service does not store full payment card details.

7. Early Access & Beta

The Service may be provided in an Early Access or Beta phase.

During this period:

  • Features may be incomplete or unstable
  • Functionality may change without notice
  • No service level guarantees are provided

8. Availability of the Service

The Service is provided on a best-effort basis.

We do not guarantee:

  • Continuous availability
  • Error-free operation
  • Uninterrupted access

9. Termination & Suspension

Access to the Service may be suspended or terminated if:

  • These Terms are violated
  • The Service is misused
  • Security or legal risks are detected

Where possible, reasonable notice will be provided.

10. Intellectual Property

All rights related to the Service, including software, design, and content, remain the property of Zanware Marine or its licensors.

Users are granted a limited, non-exclusive, non-transferable right to use the Service.

11. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided “as is” and “as available”
  • No warranties are provided regarding performance or suitability
  • Zanware Marine shall not be liable for:
    • indirect damages
    • loss of data
    • operational losses

Total liability, if applicable, shall not exceed the amount paid by the user.

12. Disclaimer

The Service is intended solely as a management and support tool.

Zanware Marine:

  • Does not provide legal, technical, or professional advice
  • Does not replace professional maritime judgment or decision-making
  • Is not a safety-critical or navigation system

Users acknowledge that:

  • All operational decisions remain their sole responsibility
  • Data stored in the Service may be incomplete or inaccurate
  • The Service must not be relied upon as the sole source for safety or operational decisions

Users are strongly advised to:

  • Maintain independent backups
  • Verify critical information
  • Use professional judgment at all times

13. Changes to the Service and Terms

Zanware Marine reserves the right to:

  • Modify the Service
  • Update these Terms

Continued use of the Service constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Spain.

Any disputes shall be subject to the jurisdiction of the competent courts of Spain.

15. Relationship with Privacy Policy

These Terms must be read together with the Privacy Policy.

In case of conflict:

  • These Terms govern the use of the Service
  • The Privacy Policy governs data processing

16. Language In case of discrepancies between translations, the English version shall prevail.
